1.ONLINE CONTRACT
By "online" sales contract we mean the distance contract and that is the legal transaction concerning movable goods and/or services stipulated between a supplier, Fugazi Ent. of Campo Alberto (from here onwards the name Fugazi Ent. will be used) with registered office in Verona, Corso Castelvecchio 29 and a consumer in the context of a distance selling system organized by the supplier who, for this contract, uses the technology of distance communication called "internet". All contracts, therefore, will be concluded directly through access by the consumer customer to the website corresponding to the address: fugazient.it where, following the indicated procedures, the contract for the purchase of the goods will be concluded. By final consumer we mean the natural person who purchases goods and services for purposes not directly related to any professional activity carried out. Below are the conditions of sale which will remain effective until changed by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the website and will refer to sales made from that moment onwards.
2. Sales prices and purchase methods
All sales prices of the services displayed and indicated on the website, for which they constitute an offer to the public pursuant to art. 1336 cc, are inclusive of VAT and all other taxes (unless otherwise indicated). Where applicable, a transport cost is duly highlighted on the appropriate page within the site which the customer will take care to view before confirming the purchase; in the case of delivery abroad, any additional costs due to taxes or duties provided for by the legislation in force in the country of destination will be borne by the consumer. The purchase contract is finalized through the exact compilation and the consent to the purchase expressed through the "online" subscription. The customer can pay for the goods ordered using only the payment methods indicated online at the time of purchase.

3. Buyer's obligations
The consumer undertakes and obliges, once the online purchase procedure has been completed, to print and keep these general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product object of the purchase, and this in order to fully satisfy the condition set out in the articles. 3 and 4 of the Decree. Legislative n° 185/1999. The buyer is strictly prohibited from entering false, and/or invented, and/or imaginary data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively your real personal data and not of third parties, or fictitious. It is expressly forbidden to make double registrations corresponding to a single person or enter data of third parties. The company reserves the right to legally prosecute any violation and abuse, in the interest and protection of all consumers.
4. Right of withdrawal and complaints
The consumer who for any reason is not satisfied with the purchase made has the right to withdraw from the purchase, without any penalty and without specifying the reason, within 14 working days from the conclusion of the contract. The withdrawal must be expressed by sending a registered letter with acknowledgment of receipt within the aforementioned 14 day period to the following address: Fugazi Ent. of Campo Alberto, Corso Castelvecchio 29, Verona. The consumer cannot exercise this right of withdrawal for products made to measure or clearly personalized or which, by their nature, cannot be returned or risk deteriorating or altering rapidly. Within the aforementioned period of 14 days, all purchased goods must be returned to the sender-supplier intact and in their original packaging, without any defects. Return fees will be charged to the customer. Once the request has been received, the company will send a purchase voucher of equal value to be used within 30 days.
5. Contractual termination and express termination clause
Fugazi Ent has the right to terminate the stipulated sales contract by simply communicating this to the customer with adequate and justified reasons; in this case the customer will only have the right to a refund of any sum already assumed and paid.
6. Jurisdiction and competent court
Any dispute relating to the application, execution, interpretation and violation of purchase contracts stipulated "online" through the moveshop.it website is subject to Italian jurisdiction; these general conditions refer, although not expressly provided therein, to the combined provisions of Legislative Decree no. 50 of 15.1.1992 and Legislative Decree no. 185 of 22.5.1999. For any dispute between the parties regarding this contract, the Court of residence of the Customer or elective domicile of the final consumer will be competent (Art. 1469 Bis N° 19). 7. Privacy Policy:
European citizens and any person residing even temporarily on EU territory have the right to have their data processed in accordance with EU Regulation 2016/679.
Data owner:
Fugazi ENt. with Registered Office: Corso Castelvecchio 29 – 37121 Verona (VR) – ITALY, is the OWNER of the personal data collected by the website www.fugazient.it. It is possible to contact the Data Controller by email at info@fugazient. Fugazi Ent. is not required to appoint a DPO pursuant to art. 37 of the GDPR.
Collected data:
The site collects personal data spontaneously entered by the interested party during the creation of the account or for the purchase of products. The site collects data relating to navigation and identification codes through so-called "cookies" as specified below. Fugazi Ent. does not process personal data of minors under the age of 16 nor data pursuant to art. 9 of the GDPR.
Purpose of processing:
Personal data are processed, without carrying out any formal or automatic verification, on the equipment and systems of the Data Controller or of a trusted Manager in order to:
• carry out an assignment received, ship the purchased products, manage orders and relationships with customers, fulfill legal obligations. These treatments are to be considered mandatory as they are necessary and failure to provide the data jeopardizes the provision of the services.
• send information and commercial proposals via email or other communication tools. This processing is optional, requires the consent of the interested party but allows us to offer a better service.
Data recipients:
The data may be processed by officials and collaborators within the organization. Personal data may also be processed by parties external to the organization, such as shipping companies, public bodies, professionals and technicians who carry out maintenance and control operations on the equipment.
Data transfer to third countries:
The data collected may be transferred to non-EU countries that offer guarantees of protection as per articles 45 and 46 of the GDPR.
Duration of treatment:
The processing of personal data has no deadline and the data may also be processed only for internal archiving within the organization until consent is revoked.
Right of the interested party:
• Right to information. The interested party has the right to know the categories and purposes of the personal data stored or processed by Fugazi Ent.
• Right to modify or rectify. The interested party has the right to rectify or modify their data by sending an electronic communication that allows their unambiguous and secure recognition.
• Right to restriction or deletion. The interested party has the right to revoke consent to the processing of their data limited to the cases provided for by the GDPR, by sending an electronic communication that allows their unambiguous and secure recognition. The data will be deleted considering the technical measures available and the reasonable efforts necessary also in relation to the purposes and rights pursued.
• Right of portability. The interested party has the right to receive their data in an intelligible and standard format in the ways and limits of the available techniques and reasonable efforts necessary for extraction.
Automatic processes:
The data collected is automatically processed to create archives within the organization. No activities attributable to profiling of the interested party are carried out.
